Meridian Holidays Dambadiva Tours - Terms and Conditions

Please take the time to read and understand the terms and conditions of travel set out below before confirming your reservation with Meridian Holidays - Dambadiva Tours, which are enforced on you by Meridian Holidays Katharagama (Pvt) Ltd.
1. Definitions & Interpretation: In these Terms and Conditions (“Terms”):• “Company,” “we,” “us,” and “our” mean Meridian Holidays Katharagama (Pvt) Ltd, registration no: P V 123947, whose registered office is set out in clause 24.• “Client,” “you,” and “your” mean each person named on the booking (including anyone who is added or substituted at a later date) and, where the context permits, any person on whose behalf a booking is made.• “Tour” means the package of travel services, arrangements, or products sold or offered by the company.• “Force Majeure Event” has the meaning given in clause 20. Headings are for convenience only and do not affect interpretation. References to statutes include amendments and re-enactments. Singular includes plural and vice versa.
2. The Agreement & Acceptance: 2.1 A binding contract is formed when we issue written confirmation of your booking (“Booking Confirmation”). By paying any deposit, full balance, or otherwise instructing us to proceed, you acknowledge that you have read, understood, and agree to be bound by these terms.2.2 The Tour is provided only by these Terms. No employee, agent, or representative of the company has the authority to vary them without our written approval by a Director.
3. Accuracy of Information: 3.1 All reasonable care has been taken to ensure that the information on our website, brochures, advertisements, social-media posts, or emails is correct at the time of publication. However, programme details, prices, flight times, carriers, hotel standards, and other particulars may change due to circumstances beyond our control.3.2 We reserve the right to levy a surcharge or vary the Tour price to allow for, inter alia, currency fluctuations, increases in airfares, fuel, taxes, or government-imposed charges. You will be notified in writing and given an option to cancel under clause eight.
4. Validity of Dates & Prices: 4.1 All itineraries, transfer schedules, and prices quoted are valid from 1 March 2021 to 28 February 2028 unless expressly stated otherwise. Prices are shown in Sri Lankan Rupees (LKR); equivalents in other currencies are indicative only.
5. Baggage Allowance: 5.1 Unless otherwise stated by the operating carrier, the included allowance is 25 kg of checked baggage (One piece only) and 7 kg of cabin baggage (One piece) per passenger. Excess baggage or baggage charges are your responsibility and are payable directly to the airline.
6. Reservations & Deposit: 6.1 A non-refundable deposit equal to 50 per cent of the total tour price is payable at the time of booking.6.2 The balance is due no later than forty-five (45) days before the scheduled departure date. Bookings made within 45 days of departure must be paid in full at the time of confirmation. Late payments may result in cancellation and the application of the fees in clause 8.6.3. Payments must be made to the bank account specified in our invoice. International residents may remit funds to our designated Australian bank account. No employee is authorised to accept hard cash, and the Company will not take any responsibility related to such payments. Respective bank account details will be submitted to you once your tour application is approved.
7. Payments via Agents & Third Parties: 7.1 We do not accept any responsibility related to your payments to agents or third parties on our behalf. In addition to our bank account maintained in Hatton National Bank, we authorised your deposits made to the bank account in the name of Sri Lankan Tours and Holidays in Westpac Bank in Australia.
8. Cancellation by the Client: 8.1 Cancellations must be notified to us in writing. The following fees apply once we receive your notice:
*Notice us 45 days or more: Cancellation surcharge LKR 40,000 per traveler plus any non-refundable airfare, visa, or hotel costs already paid. *Notice us 0 – 44 days: 100 % of the total Tour price. 8.2 The above fees represent genuine pre-estimates of our losses.
9. Amendments by the Client: 9.1 Once confirmed, no amendments (including name changes, date changes, or substitutions) are permitted.
10. Changes or Cancellation by the Company: 10.1 We may cancel or materially amend a tour at any time for operational reasons, safety, or Force Majeure Events. Where practicable, we will offer a replacement tour of comparable standard; failing that, we will refund all monies paid.10.2 Such refund shall constitute full settlement, and we shall have no further liability for consequential loss.
11. Passports, Visas & Immigration: 11.1 We assist Sri Lankan nationals residing in Sri Lanka to obtain Indian and Nepalese visas. You must supply a recent colour photograph measuring 51 mm × 51 mm (2 in × 2 in) and any documentation, including your passports, that we reasonably require.11.2 Non-Sri Lankan residents are responsible for ensuring that their passports, visas, and other travel documents are valid for the duration of the tour.11.3 Any refusal of entry, deportation, or detention is at your own risk and expense; clause 19 applies.
12. Health, Fitness & Medical Requirements: 12.1 You must advise us in writing at the time of booking of any pre-existing medical condition, disability, or mobility issue that could reasonably be expected to affect your participation. We may request a medical clearance at your cost.12.2 You warrant that you are physically fit to undertake the tour, will carry sufficient medication, and will reconfirm any conditions with the tour guide on departure.12.3 Medical facilities may be remote or unavailable; by booking, you acknowledge and accept the associated risks.
13. Travel Insurance: 13.1 Travel insurance is included in your package.
14. Accommodation 14.1 Accommodation is provided in 4-star hotels (or local equivalent) on a twin-share basis with either one double bed or two single beds.14.2 A single-room supplement of LKR 96,000 applies where sole occupancy is requested or required.14.3 Up to two children under 12 may share a room with two adults at an additional charge, advised on request.
15. Meals & Dietary Requirements: 15.1 All meals stated in the itinerary are included and are ordinarily provided as premium buffet service.15.2 Special dietary requirements must be declared at the time of booking. We cannot guarantee that all such requests can be accommodated, and no refunds will be given for meals not taken.15.3 We provide bottled drinking water throughout the tour.
16. Baggage & Personal Effects: 16.1 All baggage and personal items are carried at your risk at all times. We are not liable for loss, theft, or damage howsoever caused, including the acts or omissions of third-party carriers or hotels. Appropriate insurance is strongly recommended.
17. Photography, Video & Marketing: 17.1 You grant the company a perpetual, royalty-free, worldwide license to use photographs, video, and audio recordings in which you may appear, taken by our staff or agents during the Tour, for bona fide promotional or marketing purposes in any medium. You release all claims to remuneration or approval.
18. Alcohol & Prohibited Substances: 18.1 Consumption of alcohol is not permitted during the tour.18.2 The possession, carriage, or consumption of alcohol in the Indian state of Bihar is illegal. Any breach is solely at your risk, and we accept no liability or obligation to provide assistance. 19. International Travel Restrictions & Deportation: 19.1 Suppose you are denied boarding, entry, or exit, held by immigration authorities, or otherwise prevented from completing the tour for reasons including invalid documentation or breach of local laws. In that case, no refund is payable, and we shall have no further liability to you.
20. Force Majeure 20.1 The company is not liable for, and no refund is due in respect of, any delay, cancellation, or alteration caused directly or indirectly by events beyond our reasonable control, including but not limited to acts of war, civil unrest, insurrection, terrorism, civil disorder, strikes, natural disasters, epidemics, government restrictions, or failures of third-party suppliers (“Force Majeure Event”).
21. Limitation of Liability & Indemnity: 21.1 Our liability, whether arising in contract, tort (including negligence), statute, or otherwise, is limited to the amount actually paid by you for the relevant Tour.21.2 We are not liable for indirect, consequential, or incidental loss, including loss of enjoyment, delay, or disappointment.21.3 You indemnify and hold us harmless against any claims, losses, damages, costs, or expenses (including legal fees) arising out of your acts, omissions, or breach of these Terms.
22. Privacy: 22.1 We collect and process personal data strictly to provide the tour and ancillary services.22.2 We may disclose your information to carriers, hotels, insurers, government border agencies, and other service providers on a need-to-know basis.22.3 Our full privacy policy is available on request or on our website.
23. Governing Law & Jurisdiction: These terms, and any dispute arising out of or in connection with them or with the tour, are governed by the laws of the Democratic Socialist Republic of Sri Lanka. The parties submit to the exclusive jurisdiction of the District Courts of Monaragala, Sri Lanka.
